FWC... The Ball Is In Your Court...A VERY Simple, Fool-Proof Solution To All Of The Net Problems

And The CCA Could Not "Sue" You!

The Following Was Sent To Executive Director Nick Wiley and Commissioner Barco

Executive Director Wiley and Chairwoman Barco,

Since the commission and/or staff won't follow the direction of the Supreme Court in Millender, SC 85,880 to "HARMONIZE" the amendment to achieve it's ONLY purpose, AKA "Voter Intent," which was and is to, "PREVENT unnecessary killing, overharvest and waste..."

And...

The commissioners KNOW what is being done to the resource through their own tests... (98% waste in complete violation of the Amendment's Single Subject Rule.)

And...

The commissioners claim to "care" about what is happening to the environment, economy, fishermen and their families...

And...

The commissioners say there is "nothing they can do" to prevent the "unnecessary killing and waste" as far as the way that the amendment is written...

THERE IS A VERY SIMPLE, LEGAL SOLUTION...

Agree with us in court that the "inconsistent part" of the amendment related to "gilling and entangling" that apparently is causing your Constitutional Body to issue "absurd and common sense defying rules" (See Millender, SC 85,880), should be removed via the following clause in Article X, Section 16. (Obsolete Statutes and Rules would also need to be changed or removed to finish the attempt to finally achieve "Voter Intent.")


Article X, Section 16 (5)(g) "If any portion of this section is held invalid for any reason, the remaining portion of this section, to the fullest extent possible, shall be severed from the void portion and given the fullest possible force and application."

The resulting 500 square foot monofilament nets with any size mesh will not only stop the unnecessary killing and waste, it also will achieve the "voter intent" of providing a "commercially viable" net as clearly defined in Millender, SC 85,880. Additionally, the change will finally provide our elderly and disabled fishermen a "commercially viable" net as mandated by the constitution and a means to survive.
